Ampro – Brazilian Promotional Marketing Association programs, for the first half of 2014, workshops on the Quota Law (Law No. 8.213/91), which requires companies with more than 100 full time employees to fill from 2 to 5% of their positions with disabled people.
The goal of the events is to clarify to the live marketing agencies the details and implications of this law, which imposes a fine of up to R$ 172,000 for businesses that fail to comply.
“It is important that agencies that fall under the requirement know about the possibility of being under the Ministry of Labor and Employment’s supervision, and even being target of investigative procedures by the Ministry of Labor”, warns Maria Valencia Cibele, from the Focaccia, Amaral and Salvia lawyers office, which provides legal advice to Ampro.

According to the expert, beyond people with disabilities – physical, hearing, visual, mental or multiple – professionally rehabilitated workers with a certificate provided by Social Security can be hired to fill said quota.
The number of vacancies to be provided varies according to the number of CLT employees in the agency: 2% for structures with up to 200 employees, 3% for up to 500 employees, 4% for up to 1000 employees and 5% for structures above 1000 employees in CLT regime.
“It is noteworthy that, for the calculation and compliance with the quota, are contractor workers, trainees and apprentices are not considered”, says Maria Cibele.
